Legacy Way is a 4.6 kilometre two lane, twin tunnel toll road. Construction began in April 2011 and was completed in early 2015. The contract is a design, construct, maintain and operate (DCMO) contract, with a 10 year operation and maintenance period.
E3 Advisory professionals performed key transaction management roles allowing selection of a Contractor with international and local partners through a competitive tender process while retaining a high degree of confidence in delivery based on the evaluation process and risk analysis undertaken and project documents developed. Roles included:
- Development of concise and clear tender documents and associated evaluation plans allowing efficient and effective evaluation of tenders and robust contract documentation
- Provision of expert advice on project risks and risk allocation (particularly from a commercial, construction and deliverability perspective) and advising on the robust development of the Project Documents
- Management of the interactive tender and evaluation process (including the risk adjustment of tenders to take into account variations between bidders in risk transfer and whole of life value)
E3 Advisory professionals supported Council in the four and a half year delivery phase as the Design & Construction Manager and Commercial Manager in Council’s integrated team, playing a key role in the project achieving Opening Completion within two weeks of its contractual date and within budget.
E3 Advisory professionals also provided transaction advice for the sale process of a 50 year tolling concession, including leading the due diligence review process, development of the transaction documents and input to commercial negotiations.
