Independent Expert for Delay and Disruption - Office and Retail Building Construction

A new $250m commercial development was constructed over a six year period to accommodate retail and office tenants.
The project includes construction and fit-out of over 20 floors to service the growing demands of office space in a CBD location with tunnel connections to neighbouring developments.
Scope of work
The client’s lawyers retained E3 Advisory to provide independent expert opinion in relation to programming and delay issues impacting the delivery and completion of the development, in response to various claims by the Developer.
Support for the client on this project has involved:
- Assessment of delay – developing program completion projections using alternative scenarios to analyse program impacts caused by changes to the original contract scope of works
- Assessment of disruption – analysis of disruption to the works caused by key client decisions
The dispute resolution process between the parties is currently underway, with a mediation hearing set for later in 2015.
